David Hicks is a 32 year old Australian father of 2, and was held for over 5 years in Guantanamo Bay. David was captured in 2001 by the Northern Alliance in Afghanistan, and served a 9 month prison term in Adelaide's Yatala Prison. It has been well documented that torture takes place at Guantanamo Bay. You can not convict someone based on confessions made while being tortured (Or coercion, or stress and duress, or whatever you want to call it).
David did not admit that he was guilty of the (unlawful)charges against him, he admitted that the Military Commission held enough evidence against him to convict him. This is not an admission of guilt, and he did not have access to the 'evidence' the US Military had against him. Many people believe that he went along with it to get out of Guantanamo Bay.
The Military Commissions breach fair trial standards set out in the Universal Declaration of Human Rights. The Military Commissions do not deliver a fair trial.
