His special friend and roommate has continued on for both of them.
Tolly Carr sentenced Monday, August 13, 2007- ACTIVE PRISON TIME of 25-39 MONTHS for Casey's death.
Tolly Carr appeared in court in Winston-Salem on Monday, August 13, 2007 to plead guilty to all charges related to the drunk driving accident that killed Casey Bokhoven.
The court proceedings, which lasted most of the workday, were broadcast live both on the Internet on wxii12.com and for some time on live television to local viewers.
Judge John W. Smith II of Wilmington sentenced Tolly Carr to 25- 39 months for felony death by motor vehicle. The sentence is active. The defense attempted to tell the judge if anyone was worthy of a suspended sentence for Casey's death it would be Tolly Carr. Thankfully, the judge didn't buy that, but explicitly stated he felt real prison time for the serious nature of the crime was in order.
Bill O'Neil, a WXII reporter analyzed the sentence saying that with time served and good behaviour, Tolly Carr could actually be in prison for under two years. I know I heard mention of recommendation of work release.
I am relieved that he received some prison time because it was fair and the Bokhoven family needed that to happen. Also, a message needed to be sent to the community and drunk drivers everywhere- A message that would say driving drunk is wrong and if you do it and hurt or kill a person, you must pay. However, we all know that people always think it won't happen to them, but at least the message was sent.
The amount of prison time for killing someone still seems pitiful, but earlier today I thought there was a real possibility of Tolly Carr getting time served and community service.
Because Tolly Carr had no priors, the most prison time per state guidelines (which thankfully were revamped not long ago)he could have received for Casey's death was 47 months. A person with priors would have faced the high end. The judge said he weighed mitigating factors against the aggravating factor (reckless disregard for human life using the truck as a weapon) and despite the fact that he listed several mitigating factors (Tolly putting himself in jail, going to rehab, offering to do anti drunk driving talks to school kids, admitting guilt- see, that's what makes it hard to know true remorse because that is what his lawyers could have told him to do), the judge acted like the mitigating factors were balanced with the one aggravating factor. The judge has the prerogative in the state of North Carolina to make the decision of how the factors are balanced.
That is fortunate because the judge went for a sentence on the higher end of the middle range of what he was allowed to hand down.
So ultimately, I think getting 39 months out of a possible 47 was good.
The extrapolated results of Tolly Carr's blood alcohol content were revealed to be in a range of .16 and .23 at the time he hit and killed Casey, with a median value of .20. In North Carolina, .08 is the legal limit. It was stated that the results revealed that based on blood alcohol content, Tolly Carr consumed somewhere between 12 and 22 drinks that night, with a median of 17 drinks.
As for the sentence for injury to Tolly Carr's passenger, Fjola Wilson looked directly at the judge during testimony and said she did not want her friend to go to prison on her account. Therefore, the judge gave him a suspended sentence of 16-20 months for the felony serious injury by motor vehicle.
At one point, probation of 6 months was mentioned (possibly after he serves the sentence for Casey's death) and 100 hours of community service. Also, Carr was ordered to pay $10,000 to the public schools. I am not sure exactly which public schools or to be designated for what purpose (maybe drunk driving education?)
Tolly Carr's driving license was permanently revoked.
Tolly appears to have remorse, and that was also good to see. He turned and apologized directly to the Bokhovens, and especially Sean, Casey's brother, because Tolly felt he identified most with him as he has a younger brother as well. He still used some of the same jargon he spoke in the church video.
ETA- Tolly Carr was moved to a facility in Salisbury, North Carolina. He will go through physical, mental and emotional tests to determine what level prison he will be sent to- minimum, medium or maximum security.

WINSTON-SALEM, N.C. -- WXII 12 anchor Tolly Carr was sentenced Monday to 25 to 39 months in prison for felony death by motor vehicle after he admitted guilt in connection with a March pedestrian death.
Judge John Smith's decision Monday followed several hours of testimony from police officers, members of the Bokhoven family and a woman who was with Carr the night of the fatal crash.
An apologetic Carr entered the guilty plea in a Forsyth County courtroom that included members of his family and that of Casey Bokhoven, the 26-year-old who was killed in the March 11 crash.
"I should be the one who's dead," Carr said Monday afternoon. "I shouldn't be here, breathing the air in this courtroom."
Smith said Carr will receive a 16-to-20 month suspended sentence for felony serious injury by vehicle. He must serve 100 hours of community service. Carr was fined $10,000 and his driver's license was revoked.
About 90 minutes before the sentence, Carr addressed the Bokhoven family.
"I love my brother and sister," Carr said. "If anything ever happened to them, I don't know what I'd do."
Graphic images and testimony were part of Monday's court developments that saw members of the victim's family take the stand, along with a woman who said she had been drinking with Carr that night.
Carr was charged with felony death by vehicle, felony serious injury by vehicle and driving while impaired. Carr faced anywhere from probation to as much as five years in prison.
Forsyth County Assistant District Attorney Jim O'Neill pushed for Carr to receive the maximum sentence, saying it would send a strong message about drinking and driving.
Carr's attorney, Locke Clifford, argued for a lighter sentence.
"He will continue to rehabilitate himself everyday for the rest of his life," Clifford said of Carr. "That's just the kind of person he is."
Smith, of New Hanover County, presided over Monday's hearing inside a packed courtroom. Smith read to Carr the charges and possible sentences and asked if Carr understood. Carr said he did.
Sean Bokhoven asked the judge to impose the maximum sentence. During his testimony, he talked about calling his parents after the crash to let them know what happened to his brother.
He said regardless of the length of an imposed sentence, Carr's family "will get to see him again. We won't get to see Casey."
Casey Bokhoven's mother and father also addressed the court and showed a video about their son's life.
Fjola Ingvadottir Wilson, 33, was with Carr the night of the accident and was injured. She was treated at Baptist Hospital. During her sometimes tearful testimony Monday, she talked about working with Carr at WXII.
"He's the hardest worker I know," Wilson said. "He's very driven." She offered an apology to the Bokhoven family.
"Our intention was to go out with friends and have a quiet night," she said. "It was never intended to hurt anyone or take the life of anyone."
Winston-Salem police officers Greg Popp, David Richardson and Sgt. Jeff Stutts were the first to take the witness stand Monday, as they took questions about the early-morning crash.
A number of graphic photos from the crash scene were displayed. Smith told court observers to leave the room if they thought the photos would bother them. Bokhoven's mother was among those who left the courtroom. Bokhoven's father and brother remained in the courtroom but turned their heads away when some of the images were displayed.
One of the photos showed blood on the building where Bokhoven had been standing before being hit.
WXII 12's Bill O'Neil said Carr "watched, intensely at times, every bit of the evidence that was introduced, all those photos that were shown."
Winston-Salem police said Carr was driving a 1997 Ford pickup west on West First Street at about 3:30 a.m. on March 11.
He entered a marked work zone at the intersection of Burke Street and continued traveling west in the work zone toward Hawthorne Road, according to officers.
As he approached Hawthorne Road, Carr ran off the road to the right and hit Bokhoven, police said. Carr continued traveling on the sidewalk and collided with a building, police said.
Prosecutors in early May said Carr's blood-alcohol level was .13 when it was taken, about four hours after Bokhoven was hit and killed. Drivers in North Carolina are considered legally drunk if they have a blood-alcohol level of .08.
According to police, Carr refused to take a breathalyzer test at the scene. A magistrate then issued a search warrant for two vials of blood.
Smith is a special Superior Court judge who was appointed by the governor and not elected by voters.
A civil suit was filed in May against Carr, 6th & Vine, Sounds on Burke Street and Burke Street Pub. It seeks both punitive and compensatory damages in excess of $10,000.

I hope to emerge from prison a better man whose number one priority is to contribute to our society. I am terribly sorry for the tragedy that I have forced the Bokhovens to endure, and I hope that everyone will consider their privacy so they may continue to grieve. I've disappointed a lot of people through my irresponsible actions, including family members and friends, who have supported me throughout my life. Please, forgive me. Thank you dearly for all who have sent words of encouragement since the accident. To everyone hearing these words, if you will elect to drink, please don't drive. You have everything to lose, and nothing to gain."

Tolly Carr in prison- now what?
The criminal trial is over and Tolly Carr is currently serving his prison time at Warren Correctional Institution, a medium-security prison in Warren County, located northeast of Raleigh, NC near the Virginia border.The civil suit filed by Howard Bokhoven, Casey's dad, against Tolly Carr and the three bars which allegedly served him March 10-11, 2007 before the accident, is still pending. It could go to a jury trial, but it could be settled out of court through arbitration. The results of the civil suit may provide a sense of justice in and of itself.

Seven months ago...
Seven months since March 11, 2007, when Casey Bokhoven was killed as he stood on a sidewalk in Winston-Salem, just feet away from his home.
Struck by the pickup truck of a drunk newsman careening down the West First Street hill in Winston-Salem, in the dark, no headlights on.
Killed by an educated, successful man, who made the tragic decision to try to drive home after a night on the town rather than take a cab.
Tolly Carr has pled guilty and has been sentenced. It may be easy for some of us to let the memory of Casey's death fade to the point of forgetting.
It hasn't faded for Casey's family or his friends, and they will never forget. Perhaps they are beginning to adjust to the idea that Casey is not here, but the pain is still there and losing him feels terrible.
Tolly Carr is now in prison, paying for a night of reckless irresponsibility, living a life he couldn't have imagined he would live because he took a life of another.
But, he is alive and those who wait for him have the hope of a reunion in the future.
But others wait for Casey, their hearts forgetting what their minds still have trouble grasping: there will be no reunion with their son, brother, uncle, friend, boyfriend, roommate or coworker, at least on this earth.
Rest in Peace, Casey.
