Defense: Ella evidence obtained illegally

The defense attorney for a Cocoa woman accused of moving out of her home and leaving her dog behind to starve to death wants nearly all the evidence in the case to be thrown out, arguing that police illegally searched the house.
According to a motion filed by West Palm Beach attorney Andrew Stine, police shouldn't have entered Christine Abrams' home without a warrant unless there was reason to believe they or someone inside was in immediate danger, or that evidence was about to be destroyed.
It was during that search that police found the decayed body of Abrams' German shepherd, Ella, locked in a crate in the living room, a bag of dog food mere feet away.
Abrams, 30, faces up to a year in jail and a $5,000 fine if convicted on two misdemeanor counts of animal cruelty. She has pleaded not guilty.
"There was ample time to secure the home and then apply for a search warrant," Stine wrote.
A scheduling hearing set for today was pushed back to June 27 so that it could be consolidated with a hearing on Stine's motion.
But animal lovers said they still plan to rally at 8 a.m. today outside the Moore Justice Center in Viera.
Their demand: Reject any plea negotiations for Abrams.
The hearing delay "only helps our cause because it gives us more time to fire up people and get them organized," said rally organizer Nick Stack, 26, of Merritt Island.
The case has drawn worldwide attention from activists who are urging prosecutors to pursue the harshest sentence possible for Abrams, who police said told them she abandoned her home because the water was turned off. She said she left Ella behind because the male friend she moved in with didn't like dogs, police said.
When news first broke of Abrams' March 12 arrest, Stack and thousands of other animal lovers from Thailand to Texas signed petitions, created T-shirts and a Web site and flooded the state attorney's office with letters urging prosecutors to charge her with felony cruelty.
They expressed outrage when prosecutors reduced the charges against Abrams to a misdemeanor, saying state statutes on animal cruelty are unclear.
Their frustration intensified when court documents were released showing Ella's right leg was amputated in November, the result of what Abrams told a veterinarian was a leash that had wrapped around the dog's limb while she was away.
Now, they hope their public outcry will urge the state to follow the lead of other prosecutors who gained felony convictions in similar cases.
Police said they responded to Abrams' home to investigate a complaint by a neighbor, worried that he hadn't seen Abrams since Christmas. Officers saw flies swarming the window and Ella on her side in a cage in the living room.
Suspecting "foul play," Cocoa detective Eric Austin said in a report that police broke into the home, then began a missing person investigation for Abrams, described by the neighbor as an attentive pet owner often seen playing and walking the dog.
Police spent five hours calling area hospitals, jails, relatives and employers, only to find Abrams at her friend's home -- less than six miles away, police said. She'd moved there about two months earlier, they said.
In an e-mailed statement, Wayne Holmes, chief of operations at the state attorney's office, said deprivation of food and water is a misdemeanor under state statute.
To file a felony charge, prosecutors would have needed scientific evidence to establish the cause of death. But Ella's body had decomposed so badly a necropsy was impossible.

VIERA—Nearly 50 demonstrators rallied outside the Moore Justice Center today, urging prosecutors to upgrade the animal cruelty case against Christine Dawn Abrams to felony charges.
Standing in the blazing sun, the group – which included children, two dogs and animal lovers from as far as Port St. Lucie – waved signs calling for an end to animal cruelty and jail time for Abrams while passing cars honked horns in support.
After about an hour, the demonstration moved to the state attorney’s office, where rally organizers Holly Gann, Nick Stack and Denise Brooker collectively hand-delivered three petitions with more than 4,600 signatures.
They hope their public outcry will urge the state to reject any attempts by Abrams’ attorney at plea negotiations and to follow the lead of prosecutors who gained felony convictions in similar cases elsewhere. Abrams has pleaded not guilty.
They hope to double rally participation at Abrams’ next hearing at 10 a.m. June 27.

ABOUT VOICES FOR ELLA:
I have created this space to honor Ella. Her owners myspace, where she was ironically a member of an animal lovers group, and where she had posted pictures of Ella, was deleted on March 15, 2008. It is my greatest fear that Ella's story will simply fizzle away, and she will be forgotten. So far, this has not been the case.
Updates will be posted here as often as I have them. Please, don't let this precious life be forgotten.
Please add your comments and suggestions. This horrible case of animal cruelty cannot be swept under the rug.
Our mission is to spread the word against animal cruelty on Ella's behalf, and to do everything we can to make sure that she will not be forgotten, nor will the other "Ellas" who are out there in the world. We are not here to preach to anyone - We are simply here to connect those who are willing to support our cause. Voices for Ella's friends are true animal lovers. We do everything we can to be these precious creatures voices, and to save as many as possible from ever having to endure abuse. We also want to help enforce and strengthen animal abuse laws, first in Florida to Honor Ella, and then wherever else we can make a difference.

Ella's Precious Lives In Need...To Honor Ella, I will be placing a Homeless Animal, who is in need of Adoption or Rescuing, here each week.

Ella's THIRD Precious Life In Need was Durante (as in Jimmy), although she is a girl, who we recently learned was at a shelter who changed to no-kill.

Since we feel secure knowing that she is safe from being euthanized, we are now adding an URGENT kitty to this section.

We here at Voices for Ella don't take any credit for them being saved, as we don't know the full circumstances of them being rescued. We are only trying to spread the word about these precious animals, one life at a time, until we have done all we can do for them. Help us continue to spread the word! PICTURES LOCATED AT THE BOTTOM : ) Long story short, these babies were rescued out of a wooded lot on a busy street (Jupiter in NW Palm Bay) where some feral cats have started a small colony. So far we have managed to pick up NINE kittens, and the caregiver of the colony swears she counted about FIFTEEN MORE!! There are also approx. 12 adult cats that need to be spayed/neutered and released (TNR - Trap-Neuter-Release).

First things first, we need to get the nine kittens we have in our care vetted so we can place them, and recycle the funds to help the rest of the cats over there.

This is us meeting our Rescue Summer Challenge - someone came up with the idea that every rescue needs to save a life outside of their element over the Summer - here's ours! From Pit Bulls to Kittens, saving a life is saving a life!

PLEASE HELP! Jade was picked up by a very kind person on the side of a busy street. Only when the dog jumped into their car did they see the extensive damage she had endured. Our best guess, and that of the Vet, is that she was used for dog-fighting bait. Aside from the huge slash on her neck which we're unsure about - that's what the majority of her puncture wounds point to! She had to be rushed straight to the emergency vet and get stitches and staples in her neck and leg. She has been nothing but a sweetheart the entire time, and even gets along with her fosters dogs and cats! Being that it was a weekend and the Emergency vet was the only one open, we now owe $600.00 towards her care. Please donate, even if you can only spare $1.00... every little bit helps! Scarlett, the cat...

George Washington once said, "All I am I owe to my mother." Those of us who can say that are lucky, and as we commemorate our own mothers this year we also celebrate all mothers – especially those who have risen above average and made a place in our hearts by their selflessness and courage.
When we think of courageous mothers, who can forget Scarlett? She was the New York stray cat who touched the hearts of people throughout the world by using five of her nine lives to save her kittens, one by one, from a burning garage in Brooklyn, NY, and badly scorching herself in the process.
The firefighter who rescued Scarlett that day on March 30, 1996, a 17-year veteran named David Giannelli, had saved a dog from a similar fire 10 years earlier and brought it to the North Shore Animal League America shelter in Port Jefferson, Long Island. They treated the dog and named it Blaze.
"Dave never forgot what we did, so he turned to us," says Marge Stein of North Shore, where Scarlett underwent three months of life-saving medical treatment. "He got the cats together in a box and asked if could he bring them in."
When Giannelli placed Scarlett in the box with her kittens, she counted them with her nose, even though her eyes were swollen shut and her paws burned. She was named Scarlett because of the red patches that could be seen through her singed fur. The kittens were unable to open their smoke-damaged eyes and one later died. Scarlett sustained severe scorching on her face, ears and legs. She had to have the tips of her ears amputated and her eyelids were burned off.
It's been five years since the fire and five years since Scarlett was named the most famous cat in America. "There are two Scarletts that everyone can remember," says Stein. "It was a very remarkable experience. I've been here a very long time and had my share of stories that caught the media's attention, but nothing ever came close to the story of this amazing cat."
So, how is Scarlett now? "Fat," laughs Karen Wellen, the New York City writer who was chosen to adopt Scarlett four months after the fire. "She's great. She has scars and she doesn't have a lot of fur on her face. She has streaks up and down her paws where she was burned in the fire. And she has to have her lidless eyes lubricated three times a day. But she's really in great shape."
Calls About Scarlett Deluged Shelter
When the story of a cat with the heart of a lion became public, well-wishers deluged the shelter. "For months our phones rang so much they would have burned your hand," Stein says. "We got calls and letters from around the world, South Africa, France, England. They all wanted to know how she was doing, and many wanted to adopt her or the kittens."
More than 7,000 letters were sent to the shelter and more than 1,200 people wanted to adopt the cats. The shelter asked people to write a letter explaining why they wanted to adopt Scarlett. The Board of Directors made their choice after reading a letter from Wellen. In her letter, Wellen wrote of a terrible car wreck she survived in 1989 and how during her recuperation she lost Moffit, her family cat of more than 21 years.
"The physical and emotional pain I have endured through these years has made me a more compassionate person," she wrote. "And I vowed that if I ever allow another cat to enter my life it would be one with special needs."
Wellen wanted Scarlett as soon as she opened the newspaper and read the story of her heroic rescue. "I was in love with that face. I just found the fact that she had the courage to go through what she did so amazing," she says.
Scarlett's New Life
Since her adoption, Scarlett has lived mostly at Wellen's parents' house in Brooklyn, with frequent visits to Wellen's Manhattan apartment. The four surviving kittens were adopted in pairs, and Scarlett saw them only once, about a year after the fire.
"Scarlett wasn't interested in the kittens at that point," Stein says. "She held them when she needed to and then she let go. That's also something folks have to learn. When to hold and when to let go. She saved their lives then maybe thought, 'Let them make their own lives'."
Not that she is missing her brood. "Scarlett is very much a happy cat and receives love and attention from Karen and her parents," Stein says. "She comes back here [to North Shore] to have her eyes examined. She was here recently to have her teeth cleaned."
The amazing story of Scarlett has spawned a family of sorts: Wellen remains in regular contact with the families who adopted Scarlett's kittens and with the firefighter who saved them. But despite a pregnancy scare not long after the fire, there will be no more kittens: Scarlett was spayed several years ago.
According to Stein, it was important that Scarlett went to a home that had no other animals. "After her recuperation Scarlett had developed the attitude of a diva," she laughs. "She realized she had become a celebrity. She would not do well with another animal in the house. She was a star."
