They DID it all right!The co-listing agents likely made a combined commission of around $3000 off of the sale of My Moldy House...WAS IT WORTH IT? Personal apology letter to us from Earl Strickell:
Dear Mr. & Mrs. Taylor,
I am terribly sorry that you have experienced problems with this home. When we listed this property, we instructed Mr. Maurer to fill out the disclosure to the best of his ability and knowledge. In walking through this home I did not see any signs of mold or windows that leaked water and I was in this home several times, which on at least one occasion it was raining. We took measurements of each room and did not find any doors to be short and leaking water from under it. The concrete floor on the lower level had some normal settling cracks, which are normal for the area. I did not see any signs of rotting anywhere, the exterior of the home needed to be resided due to warping. I know that you had a whole house inspection, or mechanical inspection, this should have caught any and all of these problems. Again, I am sorry you have experienced these problems and I assure you I had no knowledge of any of these problems.

I am very sorry to hear about the difficulties you have encountered with the home you purchased at 9250 E Lakeshore Dr. When Earl and I listed the home I saw none of the defects you are describing.
As a part of the listing process the seller is instructed to fill out the disclosure form and to enter all problems with the home known by them on the form. My responsibility as a listing agent is to notify potential buyers of any defects known to me. I believe I did this.
A mechanical inspector also was hired by you to find problems with the house. A list of problems was given to us and this was forwarded to the seller. All items were repaired as requested.
Again, I am sorry for your trouble, but as the sellers agent in the sale I feel that my responsibilities in the transaction were met.

Typical drive-by appraisal done - ordered by my mortgage broker. Grossly over-valued. Basically, the home was appraised and valued at what was needed to get the loan closed.
Brokers and appraisers such as this are partly to blame for the current subprime mortgage crisis...

Exclusively referred to us by our realtor, Cardelia Walker: www.workinhard4u.com. We know now, that realtors are supposed to give you several recommendations for home inspectors so be wary if only one is given. I was handed his contact info and told he was a good inspector. Not so.
So even if you already have a realtor, and even if you TRUST him or her, it's wise to find and hire your own inspector.

DON'T BE FOOLED! Make sure you hire a home inspector who is a member of either ASHI or NAHI - not one that just says he is! Visit: www.ashi.org to find out more.
Additionally, be aware that there are no state requirements in Kansas for a home inspector to be licensed! So find one that is.
Mr. Yost states on his website that he's "FULLY INSURED", but, according to his lawyer and official court documents, it's quite the opposite.
It is made known on the inspection contract, that if a problem arises with Mr. Yost's home inspection, you have a certain amount of time to file a request for "mandatory binding arbitration". What it does NOT tell you, is that he won't respond to this request and then when confronted, he will pretend as if he never received the request that happened to be sent Certified with return receipt.

(Yes, that's MILLION)The mold spore total above ONLY includes one type of mold, Stachybotrys; My Moldy House has 8 different types of mold in the air, for a grand total of 1,657,706 airborne mold spores per sample. (This does not include the mold growing on walls that has not yet become airborne - there's a lot more there.)
Stachybotrys Chartarum (AKA The "Killer Mold") is a greenish-black slimy fungus that grows on high cellulose objects. What makes this mold so dangerous, and toxic, is that it produces mycotoxins. Mycotoxic POISON produced by this type of mold is called Stachybotryotoxosis.
Stachybotrys produces an extremely potent trichothecene POISON that has been used in lab experiments resulting in immune system shut-down and hemorrhaging of organs and death in rodents.
Dr. Jay Portnoy is a mold expert working at Children's Mercy Hospital in KCMO. He and his colleagues reviewed my mold inspection report and stated that they had never seen numbers that high in a home. They also stated that no living being should inhabit such a structure.

Mold Victims:
The canary went first; then my daughter's rabbit. Shortly after living in the house, four other pets were diagnosed with cancer, including 2 dogs, and died shortly after.

I'd like to meet:

The President and CEO of Century 21. (In person, so that he can't just forward my correspondance back to Miller & Midyett...) People in similar situations. Real estate professionals who are just that. People who want to help make a change.

"Century 21 Miller & Midyett Realtors, was founded in 1954 by Clarence A. Miller and Orville H. Midyett with a desire to provide real estate services to their clients above and beyond that of any other company."
This is interesting...why, then, would they put their brand name on this moldy house? In fact, Dennis Maurer, previous owner of my moldy house, contacted Coldwell Banker, Griffith & Blair Realty prior to listing it with C21. Coldwell Banker has been quoted as stating: "This house is a lawsuit waiting to happen". They refused to list it.
Had Century 21 used the same professional duty of care in determining which houses to list, they would have turned down the offer as well. They did not.
Century 21 is the world's most recognized name in real estate. It is a multi-billion dollar corporation. We contacted them as soon as we knew what was wrong with the house, and all I received were two "apology" letters from the agents.
We then took it to the media; Jim Flink did a big investigative report on the 10 o'clock news on channel 9. This was during sweeps month, so the story got unbelievable coverage. I've told everyone I know, and they've told everyone they know.
From word-of-mouth alone, numerous prospective Century 21 customers have gone to other real estate companies BECAUSE OF WHAT HAPPENED TO US. And, I'm sure there's many that I don't know about. Seems it would have just been easier to fix things right from the start...?
