Record Labels And The Relationships With Artists
A music record label is a group that produces, coordinates and distributes music records and audio cassettes to the masses. It can be a small or a large group.
Generally a record label enters into a contract with an artist or various artist groups. This agreement marks the beginning of the relationship between the artist and the record label. The exclusive agreement between the two parties involves huge sum of money and royalties attached. The label markets and sells the records to the masses by paying royalty to the artist and charging selling price from public and users.
Duration of contracts:
Contract can be short term contract or a longer term contract Contracts can be extended from short term to medium term to long term. Contract can be for a specific recording or it can be general as well. All depends upon the music company and the artists.
Many artists are able to negotiate their terms and conditions to these contracts. Super power music groups are also able to do so to make the contracts favorable for themselves.
There have often been problems in these relationships however. Not every artist gets the amount promised for the royalties.
Example: Warner Bros’s case with Prince during 1994–1996 and US Senate’s case with Roger McGuinn in July 2000
All these claims counter the point that the promised royalties have not been paid to the artists. There have been rumors of people saying that ‘The Byrds’ have never received the promised royalties for their hits of , “Mr. Tambourine Man” and “Turn, Turn, Turn”.
Hence it is essential to sign a contract so that in case of such situations, one can sue the other party and verify their claims. A contract provides a mean to ensure that artist delivers recordings to group and that the label pays royalties to the artist.
A label looks for producers, recoding studios and for additional musicians when the artist is new and does not have a recording history. A label can be little less involved when he is ensured that the artist is established and has sufficient background. Hence he can only monitor and supervise the artist and the records and the output.
During the beginning of this industry, it was essential for an artist to get associated with a label. The relationship between the two varies and often involves tensions.
Changes are compulsorily made during and before the release under the belief that such changes would make the recording sell better and earn more profit. One can use entertainment lawyers to get such contracts supervised and monitored. This will avoid any hassles between the two and ensure smooth relationship.
