id like to make some comments about the battle ground known as myspace. even though im not a lawyer. id like to write an amicus curie breif..(friend of the court breif).......yes i have studied law books thourougly.as far as the myspace prank goes. unlessit caused mrs. jacobs to lose her job or pose a thread for her to lose her job and considering that it clearly didnt breach national security it is not libel, and is protected by the first ammendment.secondlyas far as using her likness with out permission seeing as how mrs. jacobs is in charge of the drama club , i would be willing to bet that , if one were to check the office file cabinets you would find a photo release consent paper ( but not any more the office is probably destroying it as we speak), and i am under the impression that these photos of her were taken on school property there is no case there. from the stories that i have heard and from my own personal experience, i REALLY AND TRUELY belive that Mrs. jacobs might have some sort of mental illness and i would highly recomend that she or a higher power (I.E. school board) allow her to be subjected to some serious professional evaluation. most of thiese scandals are centered around her. once is a coincidence, twice is a pattern. clearly it can be said that Mrs. jacobs is causing some problems. now for the infamous thomas smith situation. according to the freedom of information act of 1966 any government institution that has information on an individual must reveal that information to said individual upon written request. that means by law if thomas asks how the office found out about the books in his trunk, unless it threatens national security which it doesn't, they have to tell him. and i would like to strongly urge thomas to do so, so he can know where his loyalties lie. now then many of us have read the letter the Mr. Gaston wrote to everyone. in it it clearly says that the school knows that others were involved and yet they are still punishing himfor something he didn't do, AND ACCORDING TO MR. GASTON THEY KNOW HE DIDN'T DO IT. that sounds very unfair to me. yes him not rating out some people is wrong. but the school punishing him for crimes that, again, they know he didnt do. is even more wrong.
