SO here how it works with our REP agreement you guys get a non exclusive deal on the song we are interested in. So you give us the right via the REP agreement to pitch the song for Film's - Commercials etc. You have to sign our standard publishing contract but it only kicks in if we get the song placed with a music supervisor. PUBLISHING TERMS:
Publishing Terms –PCM Contract
For the term of the contract all rights (copyright, publishing) transfer over to the publisher who will protect the rights of the work in their assigned territory and endeavour to capitalise the use of your track by licensing the track through the medium of sheet music sales, song placement with music supervisors [film, tv, ads, release as commercial recording by other artist, multi-media...] )
The publisher is responsible for ensuring the track is registered with a performing rights society and if the songwriter is also registered with a PRS then this will be registered and royalties due to the songwriter paid via their PRS. Failing that the publisher will keep accurate records and pay royalties due to the songwriter. The writer cannot be allocated less than 50% share of royalties.
Any adaption’s made to the work by a Licensee will be credited to the original songwriter 100%.
-the songwriter will be approached concerning changes and have control over the go-ahead for such changes.
Standard 60/40 split in songwriters favour in all net royalties:
- If recorded and released by another artist
- If used in film/ TV/ Ads/ multi-media
- From sale of sheet music
And 10% of the retail selling price of any physical sales will paid to the assignor.
If the publisher acquires the services of a sub-publisher the songwriters share of net royalties is 60% of the 80% received by the publisher. DLR has an eclectic mix of artists music licensed and the catalogue is exploited worldwide and via every digital platform in the world including EMI digital in the USA. Further reciprocal relationships are currently being established via Japanese and other Asian companies to deliver the DLR catalogue via mobile networks in the future. UAM in Ireland specifically pitch the DLR catalogue to music supervisors inconjunction with PCM with the aim to create licensing opportunities in Films, TV Commercials and via other media platforms for the DLR catalogue.
