Free Pac DANBURY-- The wrong man was shot, the intended victim didn't want to talk, and a third man told investigators he was the gunman's original target. Despite the confusion and reluctance of several witnesses to cooperate, Danbury police believe they have unraveled the story behind an early morning shooting outside a White Street diner three years ago.Late Monday, they arrested reputed Latin King gang member Henry "Pacman" Mayoral, 29, of Padanaram Road, on a Superior Court warrant charging him with conspiracy to commit first-degree assault.Police said Mayoral told another alleged gang member, David "Davecito" Grullon, to shoot Maurice Rosado outside Three Brothers Diner on Feb. 20, 2004, because Rosado was romantically involved with Mayoral's girlfriend.But when Grullon pulled the trigger, the semi-automatic pistol misfired, and Rosado ran off. When Grullon did manage to get off a shot, it hit Rosado's friend David Gardner, 26, in the back, coming to rest a half-inch from his heart.Police were called to the Danbury Hospital emergency room shortly after 2 a.m. and found the victim less than cooperative. Gardner said he didn't know who shot him, and an "unnamed person" had driven him to the hospital.Gardner and his cousin, Terrance Moore, told investigators they had been out drinking and stopped by the diner to get something to eat. Gardner, who survived, still has a bullet near his heart.As they walked up the diner's front steps, they heard people arguing in Spanish. Sensing a problem, they turned and started to walk away. That's when Gardner was shot, they said.The investigation of the shooting, which lasted more than a year, was additionally complicated because several of the suspects, including Mayoral and Grullon, also were targets of a joint police department-Drug Enforcement Administration investigation into a large-scale cocaine distribution ring operating in the city at the time.That investigation concluded a year after the shooting, and federal charges in the case are still pending.Four days after Gardner was wounded, investigators got a break when a man identified as John Prosser came to the police department and claimed "he was almost the victim of a shooting at the Three Brothers," according to Detective Daniel Trompetta, who prepared the warrant affidavit.Prosser said he was a Latin King but was trying to get out when he ran into four gang members at the diner. They went outside to talk, but Prosser said the four surrounded him and he thought he was going to be killed.That's when three other men walked past. Mayoral recognized one of them as a person he was having a problem with, and the gang members turned their attention away from Prosser.Police subsequently learned the man with whom Mayoral was feuding was Rosado, and the problem was that he had been seeing "Pacman's woman," according to the arrest warrant.Trompetta, Detective Craig Martin and a DEA agent then interviewed Rosado, and he admitted he had been with Gardner and Moore at the diner.
