Boy, 19, shot dead, suspects at large May 27, 2006 . By Lori Caldwell / Post-Tribune staff writer . Moments before he was killed, Marlon Joshua told a friend he was nervous because the man who shot him previously kept driving past him on the street, court records filed Friday state. . Joshua, 19, and two friends were standing outside the friends apartment at 5th Avenue and Garfield Street when the same man passed again, smiled and said, Hey, cuz, before opening fire with a Tech-9 loaded with a 30-round clip, police said. . Joshua tried to escape the hail of bullets, but the driver backed up on 5th Avenue as the victim ran west outside the apartment building. Joshua collapsed as he turned onto Garfield Street and died instantly, police said. . Donte Gildon, 22, and Lyman L. Spurlock, 27, were both charged with murder, attempted murder and attempted battery in the shooting incident Tuesday evening across the street from Horace Mann High School. . No one else was injured in the shooting. Police recovered 12 shell casings from the scene. . Detective Sgt. Jackson said Spurlock was the driver. . Joshuas friend said they saw a black car cruising through the area that afternoon. Marlon told him he didnt trust the person because he had driven by several times, and noted one of the men in the car shot him previously, the probable cause affidavit states. . The victims father, who lives in the area, told Jackson he heard shots and looked out to see a white car with a guy shooting from the passenger side. He saw the car back up and recognized Spurlock as the driver, the affidavit states. . As he watched out the window, the lady across the street from him shouted to him that his son was laying on the side of the building, court records state.
